These Terms of Use govern access to and use of the illusim.com website and the Illusim mobile application, developed by SMILESIM S.R.L. By accessing the website or installing the application, you accept these terms in full.

Part I: Website (illusim.com)

1.1 Service description

The illusim.com website is a presentation website for the Illusim mobile application. Its purpose is informational: it provides descriptions of application features, download links, and contact information.

The website does not offer user accounts, does not process payments, and does not allow direct purchases.

1.2 Intellectual property

All website content (texts, images, logos, design, source code) is the property of SMILESIM S.R.L. and is protected by copyright law.

You have the right to view and download materials from the website only for personal, non-commercial use. Copying, reproducing, distributing, or modifying the content without our written consent is prohibited.

1.3 Acceptable use

You agree to use the website lawfully and not to take actions that could:

• Affect the operation or security of the website
• Attempt unauthorized access to systems or data
• Transmit malicious or harmful content
• Violate intellectual property rights

1.4 External links

The website may contain links to external pages (App Store, social networks, etc.). SMILESIM S.R.L. does not control and assumes no responsibility for the content or privacy policies of these third-party websites.

1.5 Limitation of liability for the website

The website is provided "as is", without warranties of any kind. SMILESIM S.R.L. does not guarantee that the website will be available uninterrupted or error-free.

We are not responsible for any losses or damages resulting from the use or inability to use the website.

Part II: The Illusim Application

2.1 User account and authentication

To use the application, the user must authenticate with an Apple ID account. Illusim obtains from Apple ID only the user's first name and email address (after authentication), which are securely sent to SMILESIM servers for account creation.

The user is responsible for maintaining the confidentiality of their Apple account data (including 2FA authentications) and for using the application in accordance with the law. The minimum age is as required by Apple's terms (minimum 13 years).

2.2 Subscriptions and payments

Full access to Illusim features is available through subscription (monthly or annual access), purchased exclusively through the App Store (Apple payment methods). Payments are processed and managed by Apple - we do not store card data and have no access to it.

Each plan may include a free trial offered through the App Store. Currently, the standard trial is 3 days for the monthly plan and 7 days for the annual plan, but the exact duration and final eligibility are as displayed by Apple at the time of activation. The trial is generally available once per Apple account.

Auto-renewable subscriptions remain active until cancelled: they automatically renew at the end of each period until the user cancels them in their Apple account settings.

The subscription can be cancelled at any time by the user through the "Manage Subscriptions" section in their Apple account, following Apple's instructions. After cancellation, access to content remains active until the end of the paid period; no further payments will be made.

SMILESIM SRL does not guarantee refunds: any refund request is made in accordance with App Store policies and local legislation.

2.3 Questionnaires and descriptive assessments

Illusim includes descriptive self-awareness questionnaires, including personality profiles such as Big Five, which may be available during the trial period, depending on the active plan and current product configuration.

These results are offered exclusively for personal reflection, self-observation, and guidance in app practice. They do not constitute medical, psychological, or psychiatric diagnosis, do not replace evaluation by a specialist, and should not be used as the sole basis for medical, clinical, professional, or legal decisions.

2.4 No additional purchases

Currently, Illusim does not offer in-app purchases beyond the subscription described above. All essential features are available to subscribers.

2.5 Synchronization and result storage

The Illusim application uses progress data synchronization through iCloud and other technical mechanisms necessary for experience continuity across devices. Progress data and certain questionnaire results or summaries may be associated with the user's account.

For synchronization to work, the user must be signed in to iCloud on their device. SMILESIM S.R.L. does not have access to general personal documents in iCloud and does not share personal data with third parties for advertising purposes.

2.6 Account deletion

The user has the right to delete their account directly from the application settings (the "Delete Account" option). By this action, SMILESIM will delete the name and email address associated with the account from our database and will delete account data and result summaries associated with the profile, within the limits described in the privacy policy.

The App Store purchase must also be cancelled by the user in their Apple account if not already done. Progress data stored in iCloud remains in the user's iCloud account until they remove it, and data stored on our servers is handled according to the privacy policy.

After account deletion, the user will no longer have access to previously saved data on their SMILESIM account and must re-register to use the application again.

2.7 Copyright and application license

The Illusim application and all its content (design, code, texts, images, logo) are the property of SMILESIM S.R.L. All rights are reserved.

By installing the application, you are granted only a non-exclusive, non-transferable right to use the application for personal purposes. You do not have the right to copy, reproduce, distribute, modify, or create derivative works without our consent.

Use of the application must be in accordance with applicable law; we expressly prohibit its use for illegal or abusive activities.

Use of the application downloaded from the App Store is also subject to Apple's Standard End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

2.8 Limitation of liability for the application

The application is provided "as is", without any express or implied warranty. SMILESIM S.R.L. does not guarantee uninterrupted or error-free operation of the application, nor that it will meet your needs.

To the extent permitted by law, SMILESIM S.R.L. cannot be held liable for direct, indirect, incidental, special, or consequential damages (including loss of data, revenue, or business opportunities) arising from the use of the application.

In particular, our total liability cannot exceed the amount actually paid by you for the subscription in the last 12 months. If local law provides for minimum warranties, our liability will be strictly limited to those minimum legal warranties.

Part III: Common provisions

3.1 Modification of terms

SMILESIM S.R.L. reserves the right to occasionally update these terms (for example, for service improvements or legislative changes).

The updated version will be published on the website and in the application, and in case of significant changes, we will notify users by email. Continued use of the website or application after the publication of the new terms constitutes acceptance thereof.

3.2 Applicable law and jurisdiction

These Terms of Use are governed by Romanian law and applicable European Union regulations. Any dispute will be resolved amicably or, in case of failure, by the competent courts in Romania.
